By participating, entrants agree to be bound by these Official Rules and the decisions of the judges and/or Sponsor, which are binding and final on matters relating to this Promotion. Promotion is subject to all applicable federal, state and local laws.
PROMOTION PERIOD: The Snack Time Promotion (“Promotion”) begins at 12:01 a.m. Eastern Time (“ET”) on April 30, 2010 and ends at 11:59 p.m. ET on July 31, 2010 (“Promotion Period”). The Promotion Period will be divided into ninety three (93) daily entry periods and three (3) monthly entry periods. For the purposes of these Official Rules, a “day” will be defined as the twenty-four hour period from 12:00 a.m. ET to 11:59 p.m. ET, and a “month” will begin at 12:01 a.m. ET on the first day of a month and end at 11:59 p.m. ET on the last day of that month, except for the first month, which will begin on April 30, 2010 and end on May 31, 2010. Each entry period (both daily and monthly) is its own separate promotion.
TO ENTER: During the Promotion Period, there are two (2) ways to enter: 1) Visit www.MakeTimeForChange.com (“Website”), follow the directions provided to stop the clock, and log in to receive one (1) entry into that day’s drawing for a chance to win a Daily Prize (as described below) and one (1) entry into the applicable monthly drawing for a chance to win a Grand Prize (as described below). If you’re not already registered on the Website, you must register to be entered for a chance to win. Registration is free. Limit one (1) registration per person and per email address. Or, 2) to be entered into the applicable daily and monthly drawings without registering and/or stopping the clock, click here and provide your complete name, complete mailing address, telephone number (including area code), and email address. Limit (1) entry per person/email address per day, regardless of method of entry. Multiple entries received from any person/e-mail address in excess of the stated daily limit will be void. Registrations and entries generated by script, macro or other automated means or which attempt to subvert the entry process, as determined by Sponsor, will be void. Sponsor’s computer is the official time-keeping device for this Promotion.
DRAWINGS: Daily Prize Drawings: Ninety three (93) potential Daily Prize winners (one (1) per day of the Promotion Period) will be selected in random drawings which will be take place following each day of the Promotion Period from among all eligible entries received for that day (for a total of ninety three (93) separate random drawings). Non-winning entries from one day’s drawing will not carry over into the any other day’s drawing. Grand Prize Drawings: Three (3) potential Grand Prize winners (one (1) for each monthly period of the Promotion Period) will be selected in random drawings following the last day of each month from among all eligible entries received for the applicable monthly entry period (for a total of three (3) separate random drawings). Non-winning entries from one monthly drawing will not carry over into the any other monthly drawing. Odds of winning a prize depend on the number of eligible entries received for the applicable drawing.
WINNER NOTIFICATION: Potential winners will be notified by e-mail and may be required to execute and return an affidavit of eligibility, a liability release and, where lawful, a publicity release within seven (7) days of date of issuance of notice. If such documents are not returned within the specified time period, the prize notification is returned as undeliverable, Sponsor is unable to contact a potential winner within seven (7) business days of date of initial notification or the potential winner is not in compliance with these Official Rules, prize will be forfeited and, at Sponsor’s discretion, Sponsor will conduct another random drawing from all remaining eligible entries to select an alternate potential winner for the applicable drawing.
PRIZES: Daily Prizes (93) (one (1) per day): One (1) $50 American Express gift card, which may be used towards smart snacking. Approximate Retail Value (“ARV”): $50 each. Sponsor will mail gift card via U.S. mail to winner’s primary residence within the forty-eight (48) contiguous United States or the District of Columbia. Gift cards are subject to certain terms and conditions specified by issuers. Grand Prizes (3 Grand Prizes) (one (1) appliance per monthly drawing): A Frigidaire Professional French Door refrigerator, including delivery. ARV: $3,100 each. Winner must take delivery of the Grand Prize within ninety (90) days of Sponsor’s receipt of the completed winner documentation. Sponsor is not responsible for providing cabinetry or the installation of the appliances. Manufacturer’s standard written limited warranty will apply. Sponsor shall be responsible for shipping and delivery to winner’s residence within the forty-eight (48) contiguous United States or the District of Columbia. All taxes, including but not limited to federal, state and local taxes, and any other costs and expenses associated with prize acceptance and use not expressly provided for herein, are solely the responsibility of the winners, including any costs of installation and cabinetry for the Grand Prize. Winners may not substitute, assign or transfer a prize or redeem prize for cash, but Sponsor reserves the right, at its sole discretion, to substitute a prize with one of comparable or greater value. Prizes are awarded “as is” with no warranty or guarantee, either express or implied by Sponsor, except for the manufacturer’s standard written warranty included in the prize packaging for the Grand Prize. GENERAL CONDITIONS: Any entrant’s failure or refusal to comply with these Official Rules will result in his or her entries being void, and entrant being subject to disqualification from the Promotion. Released Parties (as defined below) are not responsible for lost, late, incomplete, inaccurate, stolen, misdirected, delayed, undelivered, damaged or garbled registrations or entries; or for lost, interrupted or unavailable network, server, Internet Service Provider (ISP), website, or other connections, availability or accessibility or miscommunications or failed computer, satellite, telephone or cable transmissions, lines, or technical failure or jumbled, scrambled, delayed, or misdirected transmissions or computer hardware or software malfunctions, failures or difficulties, or other errors or difficulties of any kind whether human, mechanical, electronic, computer, network, typographical, printing or otherwise relating to or in connection with the Promotion, including, without limitation, errors or difficulties which may occur in connection with the administration of the Promotion, the processing of registrations or entries, the announcement of the prizes or in any Promotion-related materials. Released Parties are also not responsible for any incorrect or inaccurate information, whether caused by site users, tampering, hacking, or by any equipment or programming associated with or utilized in the Promotion. Released Parties are not responsible for injury or damage to participants' or to any other person's computer related to or resulting from participating in this Promotion or use of the Website. Each winner, by acceptance of a prize, except where legally prohibited, grants permission for Sponsor and its designees to use his/her name, address (city and state), photograph, voice and/or other likeness and prize information for advertising, trade and promotional purposes without further compensation, in all media now known or hereafter discovered, worldwide in perpetuity, without notice or review or approval. Each winner agrees that that all contact with the media, if any, regarding the Promotion and the prize awarded shall be coordinated by Sponsor, and winner shall not discuss the Promotion or the prize with any media organization without the Sponsor’s consent. In the event of a dispute regarding entries received from multiple users having the same email account, the authorized subscriber of the email account at the time of entry will be deemed to be the entrant and must comply with these Official Rules. “Authorized account subscriber” is the natural person who is assigned the email address by the Internet Service Provider (ISP), on-line service provider, or other organization responsible for assigning email addresses.
